I wanted to write this month about the importance of EMPACT to all of our members and all of our patients. While our website does a great job of detailing the priority: giving Emergency Physicians a united voice in the political process. This bi-partisan engagement to improve emergency care across the state is essential to maintaining our ability to both care for our patients and protect them. There is a great deal of responsible, thoughtful and thorough discourse regarding how to disperse the precious funds donated. If we don’t proactively support the legislative process, our practices and our patients will suffer.
Forging meaningful relationship with policymakers involves both the commodities of time and funding. While we have a lot of generous supporters, we would multiply our influence ten-fold if every TCEP members gave just $100 to EMPACT for the year. READ MORE

2025 ACEP Council Meeting Recap

This year’s annual ACEP Council meeting was held in Salt Lake City, Utah, on September 5-6. Texas brought 21 councilors and was one of the largest state chapters represented. This year, there were ninety-one (91) resolutions to discuss and vote on. With so many resolutions to consider, many issues were discussed, and many passed. Examples include support for eliminating physician non-compete clauses in contracts, support for both three-year and four-year residency programs (opposed to changing all to four years), and providing a toolkit for elective surgery scheduling to mitigate ED crowding. Two TCEP members were recently recognized at the American College of Osteopathic Emergency Physicians (ACOEP) 2025 Awards Ceremony, which celebrates individuals who have made outstanding contributions to the college and the field of emergency medicine. Dr. Robert Suter received the distinguished Bruce D. Horton, DO, FACOEP, Lifetime Achievement Award, and Dr. Spencer Heath was honored with the Excellence in Education Award.

Government Shutdown Continues
(ACEP, 10/31) The federal government shutdown enters its fifth week with no end in sight, as partisan divisions in Congress continue to stall negotiations over a continuing resolution (CR) to reopen the government.
In the Senate, Majority Leader John Thune (R-SD) continues to hold daily votes on the House-passed CR, which includes funding through November 21, though the bill remains unable to clear the 60-vote threshold needed to advance. Minority Leader Chuck Schumer (D-NY) has successfully kept his caucus unified in opposition, arguing the measure undercuts health care subsidies and other Democratic priorities.
Meanwhile, President Trump has renewed calls for the Senate to eliminate the filibuster—an appeal that has drawn unease even among Republican senators, who fear the move could fracture the conference at a critical moment. Despite speculation that bipartisan talks will begin to take place after elections next week, no formal negotiations to reopen the government have been announced.

LSRH Workplace Violence Prevention Rules Published
On Oct. 9, 2025, HHSC adopted Texas Administrative Code (TAC) Title 26 Section 511.79, Workplace Violence Prevention. The new rule implements Senate Bill (SB) 240, 88th Legislature, Regular Session (2023). SB 240 added Texas Health and Safety Code Chapter 331, which requires a facility to:
- Establish a workplace violence prevention committee that must develop a plan to prevent and respond to incidents of workplace violence.
- Adopt, implement, and enforce a written workplace violence prevention policy.
- Respond to workplace violence incidents by providing post-incident services to health care staff, including acute medical treatment if necessary.
